CHRISTMAS AT SCORPION RANCH
LIABILITY WAIVER & ASSUMPTION OF RISK

This Liability Waiver, Assumption of Risk and Release applies to Christmas at Scorpion Ranch, taking place December 4, 5 and 6, 2026, at Scorpion Ranch, 5709 Johnson Lake Road, DeLeon Springs, Florida.

By purchasing tickets, entering the property or participating in activities at Scorpion Ranch, I acknowledge that I have had the opportunity to read this agreement in full. By accepting the event policy and entering my full legal name as my electronic signature during checkout, I voluntarily agree to the terms of this agreement for myself and, where permitted by Florida law, for any minor child for whom I am the parent or natural guardian.

FLORIDA AGRITOURISM NOTICE

Florida law provides special notice regarding the inherent risks associated with agritourism activities. Scorpion Ranch guests should understand that participation in ranch and agricultural activities may involve risks associated with land, equipment, animals and the actions of participants.

The complete statutory notice required by section 570.89, Florida Statutes, is posted at Scorpion Ranch and should be reviewed before participating in agritourism activities.

ASSUMPTION OF RISK

I understand that Scorpion Ranch is a working ranch and that entering the property and participating in ranch, agricultural, recreational and event activities involves inherent risks that cannot always be eliminated, even when reasonable precautions are taken.

These risks may include, but are not limited to:

• Contact or interaction with horses, cows, donkeys, goats, chickens, ducks and other animals.

• Unpredictable animal behavior, including kicking, biting, scratching, pecking, stepping on a person, sudden movement or other unexpected reactions.

• Uneven or changing terrain, including grass, dirt, sand, mud, holes, roots, rocks, wet areas and other natural conditions.

• Slips, trips and falls.

• Contact with fences, gates, barns, structures, landscaping, farm equipment or other objects commonly found on ranch property.

• Exposure to insects, wildlife, plants, dust, pollen and other naturally occurring outdoor conditions.

• Exposure to heat, cold, rain, wind, sun, humidity or other weather conditions.

• Boarding, riding in and exiting hayride wagons or other ranch transportation.

• Movement of tractors, vehicles, trailers, wagons or other equipment.

• Participation in inflatables, children's activities, games and other recreational activities.

• Collisions or contact with other guests or participants.

• The actions or conduct of other participants, including children.

I understand that this list does not include every possible risk associated with visiting or participating in activities at Scorpion Ranch.

I voluntarily choose to enter the property and participate in activities with knowledge of these risks. I knowingly and voluntarily assume the inherent risks associated with my participation.

RELEASE OF LIABILITY

To the fullest extent permitted by Florida law, I release and hold harmless Scorpion Ranch, LLC, its owners, employees, agents, representatives, volunteers and affiliates from claims for personal injury, death or property damage arising from inherent risks that are a natural, ordinary or unavoidable part of the ranch, agritourism, recreational or event activities in which I voluntarily participate.

This release is intended to apply only to claims that may lawfully be released or waived under Florida law.

Nothing in this agreement is intended to release or excuse conduct that cannot legally be waived, including intentional misconduct or other liability that Florida law does not permit a participant to release in advance.

MINOR CHILDREN

Children must remain under the supervision of a responsible adult at all times while on Scorpion Ranch property.

If I am purchasing admission for or bringing a minor child to Christmas at Scorpion Ranch, I represent that I am the child's parent or natural guardian or otherwise have lawful authority to supervise that child.

I understand that children participating in ranch, animal, hayride, inflatable and recreational activities may encounter the same inherent risks described throughout this agreement.

I agree to supervise every minor child in my care and to ensure that each child follows all posted rules and instructions provided by Scorpion Ranch personnel.

Florida law contains a specific notice that must be provided when a natural guardian agrees in advance to release certain claims belonging to a minor child arising from the inherent risks of a commercial activity. That statutory notice applies in addition to the terms stated in this agreement where required by law.

RANCH RULES & GUEST RESPONSIBILITIES

For the safety of our guests, animals and staff, I agree that I and all minor children under my supervision will follow all posted rules and all instructions provided by Scorpion Ranch personnel.

I agree that:

• Children in my care will remain properly supervised at all times.

• I will not enter animal enclosures, barns, restricted areas, equipment areas or other areas marked as closed unless specifically permitted by Scorpion Ranch personnel.

• I will not allow children in my care to enter restricted areas.

• I will not chase, tease, frighten, strike or intentionally disturb any animal.

• I will only touch, approach, handle or feed animals when permitted and will follow instructions given by Scorpion Ranch personnel.

• I will not feed animals outside food or other substances unless expressly permitted.

• I will follow instructions regarding hayrides, inflatables, children's activities and other attractions.

• I will use reasonable care while walking through ranch property and will remain aware of uneven ground and changing outdoor conditions.

• I understand that closed-toe shoes are strongly recommended.

Scorpion Ranch reserves the right to restrict or discontinue a person's participation in an activity or require a person to leave the property if Scorpion Ranch reasonably determines that the person is acting unsafely, disregarding instructions, creating a danger to another guest or animal, damaging property or interfering with the operation of the event.

HAYRIDES & RECREATIONAL ACTIVITIES

Participation in hayrides, inflatables, children's activities, games and other recreational activities is voluntary.

I understand that these activities may involve additional inherent risks, including falling, slipping, loss of balance, collisions with other participants, movement of vehicles or equipment, boarding and exiting wagons, bouncing or jumping, and other risks ordinarily associated with recreational activities.

I agree that I and any minor children under my supervision will follow posted rules, capacity restrictions, age or size requirements and instructions given by activity operators or Scorpion Ranch personnel.

I understand that certain attractions or services may be provided by independent vendors or third-party operators. Those operators may impose additional rules, participation requirements or waivers.

PERSONAL PROPERTY

I am responsible for my personal belongings and for the belongings of any minor children or other persons in my care.

To the extent permitted by law, Scorpion Ranch is not responsible for personal property that is lost, misplaced, stolen or damaged while I am on the property.

MEDICAL CONDITIONS & PERSONAL RESPONSIBILITY

I understand that it is my responsibility to determine whether I and any minor children in my care are physically able to safely participate in an activity.

I agree not to participate, or permit a child in my care to participate, in an activity that I reasonably believe is inappropriate because of a medical condition, physical limitation, allergy or other circumstance.

I understand that Scorpion Ranch cannot guarantee an allergen-free environment and that a working ranch may contain animals, animal dander, hay, grass, pollen, insects, dust and other naturally occurring substances.

EMERGENCY MEDICAL CARE

In the event of a medical emergency involving me or a minor child under my supervision, I authorize Scorpion Ranch personnel to contact 911 or other emergency medical services when reasonably believed necessary.

I understand that Scorpion Ranch does not guarantee that medical personnel will be present on the property.

I understand that I remain financially responsible for ambulance transportation, medical treatment or other emergency services provided to me or to a minor child in my care.

VOLUNTARY PARTICIPATION

Participation in Christmas at Scorpion Ranch and in individual activities offered during the event is voluntary.

I understand that I am never required to participate in an activity.

If I believe that an activity, animal interaction, condition or situation is unsafe or inappropriate for myself or a child in my care, I agree not to participate or to discontinue participation.

ELECTRONIC AGREEMENT & SIGNATURE

I understand that this agreement is being presented to me electronically in connection with the purchase of admission to Christmas at Scorpion Ranch.

I acknowledge that I have been given an opportunity to review this agreement before completing my ticket purchase.

By checking the required event-policy agreement during checkout and typing my full legal name into the electronic signature field, I confirm that:

• I have read this Liability Waiver, Assumption of Risk & Release.

• I understand its terms.

• I voluntarily agree to its terms.

• I understand that this agreement affects legal rights.

• The information I provide during checkout is accurate to the best of my knowledge.

• If I am agreeing on behalf of a minor child, I represent that I have lawful authority to do so to the extent required by Florida law.

• I intend my typed full legal name to serve as my electronic signature and as evidence of my agreement to this document.

Florida law recognizes electronic records and electronic signatures in transactions, subject to applicable substantive law and other statutory requirements.

GOVERNING LAW & SEVERABILITY

This agreement shall be governed by and interpreted according to the laws of the State of Florida.

If a court determines that any individual provision of this agreement is invalid, unlawful or unenforceable, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall continue in effect to the extent permitted by law.

ACKNOWLEDGMENT

I UNDERSTAND THAT BY AGREEING TO THIS DOCUMENT I AM ACKNOWLEDGING THE EXISTENCE OF INHERENT RISKS ASSOCIATED WITH VISITING AND PARTICIPATING IN ACTIVITIES AT SCORPION RANCH.

I CONFIRM THAT I HAVE BEEN GIVEN AN OPPORTUNITY TO READ THIS DOCUMENT BEFORE PURCHASING MY TICKETS.

I UNDERSTAND THAT MY ELECTRONIC ACCEPTANCE AND TYPED FULL LEGAL NAME ARE INTENDED TO DOCUMENT MY AGREEMENT TO THESE TERMS.
